1. Rental terms and conditions:

The rental of the car is governed by the following terms and conditions:

• The rental is daily and days are non-divisible.
• The hours of pickup of the car are from 8:00 to 18:30 Universal Time (GMT).
• The maximum deadline for returning the car to the drop-off location is 17:30 Universal Time (see Article 12 for delays).
• The maximum mileage per day is defined according to the duration of the rental as follows: – 200 km per day for a rental period of less than or equal to 3 calendar days and – 300 km per day for a total rental period of more than 3 calendar days (see Article 13 for excess mileage).
• A valid and regulatory driver’s license is required at the time of pickup of the car.

2. Rental price: The Renter agrees to pay the Owner an amount of [rental amount in CFA francs] for the duration of the rental. This amount includes the rental cost, insurance if applicable, value-added tax, and all other charges, except for exclusions based on the renter’s selection of protection or not (see ***).
3. Payment terms: The Renter agrees to pay the full rental price to the Owner before taking possession of the car.
4. Pickup of the car: The Renter agrees to pick up the car at [time and place of pickup] on the start date of the rental.
5. Use of the car: The Renter agrees to use the car with care and diligence, in accordance with applicable laws and regulations. The Renter is responsible for any damages caused to the car during the entire rental period and as long as the car remains in their possession. The Renter also agrees not to overload the vehicle and not to transport dangerous or prohibited materials in accordance with applicable laws and regulations.
6. Maintenance and repairs during car use: The Renter is responsible for regular vehicle checks and maintenance, such as regular oil and coolant level checks, as well as the cleanliness of the interior and exterior of the car during the rental period.
7. Accidents and incidents: In the event of a breakdown, accident, or any other situation that could affect the integrity of the car, the Renter shall immediately inform the Owner and follow their instructions for repairing the vehicle.
8. Insurance: The Owner has taken out third-party liability insurance for the car. The Renter remains responsible for any damages caused to the car during the rental period; however, the Renter has the option to include in their daily rental price an insurance coverage to cover accidental damages and breakage. However, the Renter remains responsible for any intentional damage or negligence on their part when the car is in their possession.
9. Deposit: The Owner reserves the right to require the Renter to pay a deposit before taking possession of the vehicle, depending on the level of risk that the contract would represent. This deposit will be refunded to the Renter at the end of the rental period, after checking the condition of the vehicle and compliance with the terms of this contract.
10. Car return: The tenant agrees to return the car to the owner at [time and location of return] on the rental end date, in good working condition, without damage, in the same cleanliness condition, and with a fuel level at least equal to that noted at the time of taking possession of the car.
11. Rental extension: If the tenant wishes to extend the rental period, he/she must inform the owner at least 24 hours before the rental end date. The extension is subject to the same conditions as those of this contract.
12. Late car return: any delay of 12 hours or more in returning the car is considered an unlawful extension of the contract, and in this case, a late penalty of at least equivalent to the daily rental price or prorated for the total duration of the delay observed may apply. The late fees may be added to any damage and interest fees the delay may cause to the owner.
13. Exceeding the contractual mileage: depending on the rental period, the included mileage average as defined in Article 1.d will be considered for verification. Any excess mileage is charged at the respective rates of 175 XOF/km for rentals of 3 days or less and 100 XOF/km for rentals of more than 3 days.

16. The owner may terminate the contract at any time if the tenant does not comply with the terms and conditions of this contract.
17. The tenant may terminate the contract or cancel their reservation without penalty up to a minimum of 3 days before the start of the contract.
18. In the case of choosing a refundable rental price, the tenant will have an additional period and can cancel their reservation without penalty up to 12 hours before the start of the contract.
19. The cancellation penalty is equivalent to 25% of the total rental price for case 9.b (non-refundable rental price) and is equal to 50% of the daily rental price for case 9.c (refundable rental price).

Disputes: Any disputes arising from this contract will be governed and interpreted in accordance with the laws in force in Togo and will be subject to the exclusive jurisdiction of the courts of Lomé Togo.
